Terms of service
1. Who these terms are between
These terms are an agreement between you and Zhai Pty Ltd (a private company being incorporated in Victoria, Australia — "Zhai", "we", "us"). They apply when you create an account, post a role, apply to a role, or otherwise use the Zhai platform at meetzhai.com or any associated app.
By using Zhai you agree to these terms, our Privacy policy, and any role-specific terms we surface in-product (for example, plan-specific terms or candidate consent).
2. Eligibility
- You must be at least 16 years old to create a candidate account, and at least 18 to enter a commercial agreement on behalf of an employer.
- You must have the legal authority to hire on behalf of the organisation you represent.
- Zhai is currently focused on the Australian market. We may decline accounts from outside Australia during the preview.
3. What Zhai does, and what it doesn't
Zhai is a software service that helps employers find and screen candidates, and helps candidates find roles. We provide tooling. We are not a labour-hire agency, not your employee, and not a party to the employment relationship between an employer and a candidate.
You — the employer — make all hiring decisions. You — the candidate — decide which roles to pursue and which terms to accept. Zhai's recommendations are advisory and do not constitute employment, financial, or legal advice.
4. Your account
- You're responsible for keeping your sign-in credentials safe.
- You must give us accurate information when you sign up and keep it current.
- One person, one account. No sharing logins across team members — invite them properly.
5. Employer obligations
When you post a role or use Zhai to source candidates, you agree to:
- Post only genuine, currently-open roles. No fishing for talent pools or market research disguised as openings.
- Comply with the Fair Work Act 2009, the relevant Modern Award or Enterprise Agreement, and Australian anti-discrimination law (Sex Discrimination Act 1984, Disability Discrimination Act 1992, Racial Discrimination Act 1975, Age Discrimination Act 2004, and equivalent state legislation).
- Pay at or above the minimum award rate, including penalty rates and casual loading where applicable. (See our Award compliance page.)
- Treat candidate information confidentially and use it only for the role you're hiring for.
- Not use Zhai to circumvent agreements you have with other recruiters or platforms.
6. Candidate obligations
- Be honest about your experience, skills, availability, and work rights.
- Don't apply to roles you have no intention of pursuing.
- Treat employers and Zhai staff with the same respect you'd expect.
7. Acceptable use
You won't:
- Scrape, copy, or systematically extract data from Zhai.
- Reverse-engineer the service or attempt to extract our prompts, models, or internal logic.
- Use Zhai to harass, defame, or discriminate against any person.
- Upload anything you don't have the right to share.
- Interfere with the service (rate-limit attacks, malware, etc.).
8. Plans, fees, and payment
During the preview, we offer:
- Starter — first three hires free, no card required.
- Team — A$150 per company per month, includes 1–3 users, A$25 per additional user per month. Unlimited briefs, unlimited hires, no placement fees.
- Enterprise — custom pricing.
Subscription fees are billed monthly in advance, in Australian dollars, and include GST where applicable. We may change pricing for new billing periods with 30 days' notice. We don't charge per-hire commission or CV credits.
NGOs, not-for-profits, and registered charities get the Team plan free, indefinitely, on verification.
9. Cancellation
You can cancel a paid plan at any time from the billing settings. Cancellation takes effect at the end of the current billing period. We don't pro-rate refunds for partial months, but if something's gone wrong on our end, talk to us — we'll make it right.
10. Service availability
We aim for high availability but don't promise uninterrupted service. We may need to take the platform down for maintenance, and we'll give notice when we can.
11. Intellectual property
Zhai (including the brand, software, design, and content) is owned by us. You get a limited, non-exclusive, non-transferable licence to use the service for its intended purpose.
You keep ownership of your own content (CVs, briefs, messages). You grant us the licence we need to host, process, and surface that content within the service, including to the people you've authorised it for.
12. AI-generated content
Zhai produces AI-generated summaries, screen notes, and recommendations. These are provided as aids to human decision-making, not as final assessments. You're responsible for the hiring decisions you make based on them. We log AI outputs and can explain the reasoning behind any recommendation on request.
13. Disclaimers
To the maximum extent permitted by law, the service is provided "as is". We don't promise that Zhai will result in a hire, a job, a particular candidate quality, or a particular salary outcome.
Nothing in these terms excludes any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded.
14. Liability
To the extent permitted by law, our total liability to you for any claim arising out of or relating to the service is capped at the fees you've paid us in the 12 months before the claim. We're not liable for indirect, incidental, or consequential losses (including lost profits or lost opportunity).
15. Suspension and termination
We may suspend or terminate your account, immediately and without refund, if you breach these terms in a serious way (fake roles, harassment, security abuse, fraud). For non-serious breaches, we'll give notice and a chance to fix things.
16. Governing law
These terms are governed by the laws of Victoria, Australia, and the parties submit to the exclusive jurisdiction of the courts of Victoria.
17. Changes
We'll update the version number and effective date above when these terms change. For material changes affecting your rights or fees, we'll notify you at least 14 days in advance.
